These terms and conditions outline the rules and regulations for the use of INCO Studio’s website, located at incostudio.com.

By accessing and using this website for these or any other purposes, you agree to be bound by these terms and conditions. If you do not accept and agree to be legally bound by and comply with these terms and conditions, you must refrain from using the website.
1.2 For the purposes of these terms and conditions, “this website” shall mean we INCO Studio. “we”, “us” and “Inco Studio” shall refer to Inco Studio Limited and “you” or “the customer” the user of this website or our services or purchase of our products.
2. Amendments to Terms and Conditions
2.1 We reserve the right to review and amend these terms and conditions from time to time. Amendments will be effective immediately and Inco Studio has no obligation to notify you of such amendments. We recommend that you check this page for amendments each time you revisit this website. Your use of this website will represent an agreement by you to be bound by the terms and conditions as amended.
3. Your Account and Password
3.1 You are able to set up an account login (with a username and password) to verify your identity when you use this website. You must ensure that your account details are complete and accurate when submitted to us, that the information that you have given is true and correct, and you must keep your account details up-to-date. You agree to not impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
3.2 Your username and password are personal to you and you must at all times keep your username and password secure and confidential and not disclose them to any third party.
3.3 You agree that you are solely responsible for any use of the website by any person using your username and password (including any purchases made via the website). 3.5 We shall not be responsible or liable, directly or indirectly, in any way for any loss damage of any kind incurred as a result of, or in connection with, your failure to comply with this section or for any delay in shutting down your account or password after you have reported a breach of security to us.
4. Pricing
4.1 All prices are shown in New Zealand dollars (NZD) and include GST (which is currently 15% sales tax – if the GST rate changes we reserve the right to immediately amend our prices accordingly). All prices are correct at time of publication, however we reserve the right to alter prices for any reason. If this should happen after you have ordered a product, we will contact you prior to processing your order.
5. Orders
5.1 By placing an order on this website you agree to and accept the terms and price specified in this website. This price may include additional delivery and other applicable charges. This offer may be accepted or rejected by Inco Studio for any reason, including, the unavailability of any product, an error in the price or the product description posted on this website, or an error in your order. Your contract with Inco Studio will only come into existence when you have fully paid for your order and Inco Studio provides confirmation that your order has been accepted and can be fulfilled. Confirmation will be sent via email to your notified email address.
5.2 We reserve the right to refuse to process an order due to suspected fraud or unauthorised or illegal activity. If such is the case, we may reject your order or our website manager may call you at the phone number you provided to confirm your order. We also reserve the right to cancel any accounts or refuse to ship to certain addresses due to suspected fraud or unauthorised or illegal activity. We take these measures to protect our customers as well as ourselves from fraud and other unauthorised or illegal activity.
5.3 All orders are subject to the availability of products. We may reject or cancel any order due to unavailability of any product. If for any reason a product is not available, we will endeavour to notify you of the non-availability on this website. We may revise the range of products or the specification of any product at any time (except where we have confirmed our acceptance of your order) without notice to you.
5.4 You may cancel your order any time prior to the time that we send our confirmation of acceptance for that order. Once we have sent our confirmation of acceptance for your order, you may not cancel that order.
6. Payment
6.1 We accept all major types of credit card – Visa and MasterCard. The name that will appear on your statement will be Inco Creative Limited.
6.2 We take all reasonable care to make our website 100% secure. All credit card transactions on this website are processed using DPS, one of New Zealand’s leading online payment systems.
6.3 In the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the website. All payments on zoeandmorgan.com are processed via a ASB payment fulfilment service. Inco Studio assumes no liability whatsoever for the availability and functionality of this service. Inco Studio assumes no liability for any financial loss caused by the use of ASB payment service.

8. Delivery
You will be required to sign for all deliveries made by registered mail and couriers. Inco Studio is not responsible for delays caused by adverse weather conditions or the customs clearance process. In the case that our carrier is unable to deliver a package due to an incorrect address entered by you, your refusal to pay duties, multiple failed attempts to reach you at point of delivery or otherwise, Inco Studio is not responsible for payment of return shipping costs or costs to resend the package. You are responsible for all shipping costs associated with returned packages due to failed delivery.
9. Refunds + Returns Policy
Only items purchased on the Inco Studio website incostudio.com can be returned for refund or exchange. Items purchased in a department store, specialty retailer or elsewhere must be returned to their original point of purchase. Should you make an error when ordering online, Inco Studio will gladly exchange for the item you intended to purchase. The returned item must be unopened and in its original saleable condition. You are responsible for the shipping and additional postage charges. In the unfortunate event that you react to a product, you have the option of exchanging or refunding it. All items must be returned to: INCO Studio 182 Ponsonby Road, Ponsonby Auckland 1011 New Zealand You are responsible for the shipping costs incurred when sending items back to Inco Studio. Should an item be damaged while it is being shipped to you, Inco Studio will provide you with a full refund or exchange. Return postage will be reimbursed in the case of damaged, defective or incorrectly sent items and a reimbursement will be issued in the original form of payment. In all cases, original proof of purchase must be provided and products must be returned within 14 days of receipt for Inco Studio to process any refund or exchange. Please email hello@incostudio.com in advance of your intentions to return or exchange a product, so that our Inco Studio team can assist you with a smooth transaction.

All content on this website, including text, graphics, logos, photographs, audio and video clips and data compilations is the property of Inco Studio or its content suppliers and protected by New Zealand and international copyright laws. The compilation of all content on this site is the exclusive property of Inco Studio and protected by New Zealand and international copyright laws.

Inco Studio and all related graphics, photographs, logos, and product and service names are trademarks (both registered and unregistered) of Inco Studio or its affiliates in other countries. These trademarks, logos and other proprietary graphics may not be used in connection with any other product or service without Inco Studio’s express prior written consent.
12. Third Party Websites
Inco Studio may include links on this website to websites owned by other parties. Inco Studio is not in any way responsible for the material contained on these sites, nor is Inco Studio responsible for the availability of these sites. Inco Studio does not endorse and is not responsible or liable for any content, including advertising or products offered on these sites, nor is Inco Studio responsible for any damage, offence or loss caused as the result of visiting these websites. Inco Studio recommends that before you visit any website you check that your computer is running up- to-date virus checking software.
13. Force Majeure
If Inco Studio is delayed or hindered in or prevented from performing any of its obligations under any Order by reason of any event or circumstance beyond its reasonable control, Inco Studio will have no liability to you in respect of such non-performance and the time for performing the same will be extended until the event or circumstance has ceased.
